Man caught hauling pot gets jail time

YORK – Kevin Cummings, 38, of Clay City, Kentucky, was stopped by deputies with the York County Sheriff’s Department and found to be in possession of a considerable amount of marijuana.

He was traveling on Interstate 80 when he was stopped.

He was initially charged with possession of more than one pound of marijuana, a Class 4 felony, and having no drug tax stamp, also a Class 4 felony.

Later, a plea agreement was reached and his charges were both reduced to attempt of a Class 4 felony. He pleaded no contest to two Class 1 misdemeanors.

He was facing a possible maximum sentence of one year in jail for each count.

This week, he was sentenced to 30 days in jail for attempt of a Class 4 felony and 30 days in jail for having no drug tax stamp. The two sentences will be served concurrently. He was given no credit for time already served.
